Right of Withdrawal for the Consumer
The purchaser can revoke the purchaser's declaration of intention to conclude the contract without stating any reasons within one month in textual form, e.g. letter, fax, e-mail or by returning the goods. The revocation period does not commence before the delivery and the reception of this instruction. Punctual dispatch suffices to comply with the time limit.

Consequences of revocation
In case of an effective revocation, any performance received by one part is to be returned to the respective other, as are benefits derived from such performance, e.g. interest. If the purchaser cannot return the goods received in whole or in part or if the purchaser can only return the perceived goods in a deteriorated state, the purchaser must pay compensation value insofar. There is no duty to pay compensation for value, of the sole cause of deterioration of the good(s) received was the inspection of the respective good(s), as would have been possible in a retail shop. For the rest the purchaser can avoid paying compensation for value in respect of deterioration in the good(s) as a result of their/its proper use, if refrain from doing anything that would curtail the value of the good(s). If the value of the order does not exceed Euro Forty (EUR 40) and the good(s) delivered correspond to the good(s) the purchaser ordered, the purchaser has to bear the costs of the return (for parcel shipment). Items not suitable for parcel post will be collected.
Obligatory refunds of payments must be made within 30 days after sending the revocation or returning the goods, for us with the receiving.

GENERAL TRADING CONDITIONS OF THE COMPANY

1. General information
 
THE COMPANY KFZ AUTOERSATZTEILE HANDEL £UKASZ ¦LIWKIEWICZ sells used  spare parts deriving from vehicles being dismantled at professional recycling centres or bought in addition from other partner companies.
The following standard general terms and conditions are valid for all offers, deliveries and other achievements.
Variant conditions or individually negotiated terms are only firm by a written confirmation of the company management.
 Different shopping or business terms of our customers are explicitly prohibited.
With the receipt of the product the purchaser accepts the general terms and conditions of the company KFZ AUTOERSATZTEILE HANDEL £UKASZ ¦LIWKIEWICZ, unless the purchaser  had the opportunity to take note of them.
The following conditions are also valid for deliveries in future without declaring them again.

2. Prices

  Spare part prices as well as the availability can be requested by e-mail. The purchaser gets informed on the same way.
The individual prices are gross prices including the value added tax (VAT). Shipping or transportation costs are not included. They will be charged separately. The amount of additional costs can be enquired at our sellers. All prices are individual prices per spare part. The prices can differ due to the state or condition. Such differences can also occur with parts of the same vehicle type because every vehicle is calculated separately due to its spare parts.
Therefore, the last price or prices of the past can not be transferred on other parts.

4. Terms of delivery

A delivery can take place based on an obliging order.
The confirmation of the order or the refusal with non-availability of a part has to be made in writing or verbal.
The delivery time is usually three working days after receipt of payment.
A damage of the product has to be noted on the cargo light or protocol of the supplier followed by informing the company KFZ AUTOERSATZTEILE HANDEL £UKASZ ¦LIWKIEWICZ  within 24 hours.
The company can not guarantee for the settlement of damages in transit with later announcement. A part returned by the customer without any defects, and no mistakes of the company leads to a storage fee raised at the rate of 10 % of the purchase price.

5. Passing of risk

The risk passes onto the buyer as soon as the delivery will be handed out to the customer.

6. Guaranty

1. The Company KFZ AUTOERSATZTEILE HANDEL  takes over the guarantee within the scope of the legal regulations for the functional ability of the sales object at the time of passing the risk under the condition that an expert installation of the parts takes place in a vehicle workshop within four weeks after the purchase.
A warranty claim is possible if the component/aggregate is in the delivered state, i.e. that no dismantling or repair work took place.   

2. With complaint about an incomplete delivery or other problems according to the amount or the type of the goods as well as externally recognizable defects or with defective product within the scope of a guarantee case the company KFZ AUTOERSATZTEILE HANDEL is responsible for touching ups, compensation deliveries or to take the goods back on the demand of the customer.
Nevertheless, we are entitled to reject finishing touches or spare delivery and to offer decrease or change to the buyer if it is not possible to the company KFZ AUTOERSATZTEILE HANDEL to perform finishing touches or spare delivery under adequate conditions.

3. Defects must be indicated by the buyer immediately in writing.

4. Removal and installation costs by the realization of guarantee work with the product delivered by the company KFZ AUTOERSATZTEILE HANDEL are not taken over from the company KFZ AUTOERSATZTEILE HANDEL.

5. A guarantee exists only if the installation has been carried out by a vehicle-master company resident in Germany, if servicing work and inspections of the vehicle were carried out according to the manufacturer's regulations (to be proved expertly) and the manual of the automobile was considered.

6. The technical effectiveness is guaranteed within the scope of the valid high-class standards of the delivered component / aggregate and its installation ability at the time of the passing of risk. Excluded from this are changes of the functional ability as a result of normal wears in the guarantee period and secondary damages based on this.

7. Requirement for the guarantee take over of engines is the renewing of the sprockets before the installation and the changing of the oil filters.

8. The guarantee limits itself to the free delivery of an equivalent or higher valued used construction part/aggregate. Should another used spare part as spare delivery not be available, the guarantee limits itself to the allowance of the purchase price.

9. If a delivered component/aggregate is defective, a free spare delivery or cost allowance follow after checking the circumstances.

10. There won’t be any guarantee, if the damage was caused by:
  - a fault with the assembly
  - delivered parts not from the company  KFZ AUTOERSATZTEILE HANDEL
  - a fault of the driver or third
  - external influences (e.g., accident, unauthorized use, flood).

11. Further claims do not exist. In particular, indirect and immediate secondary damages are not substituted.

12. Guarantee damages are to be announced immediately in writing.

13. All spare parts are delivered without liquid. For the proper filling according to the manufacturer's data the customer bears the responsibility.

14. Under the guarantee do not fall: sealing, sealing cuffs, wave sealing rings, tubes, conduits and cables, as well as spark plugs, heater plugs, screws, dowel pins and sprockets, even if these are components of an insured part or aggregate.

15.The guarantee is not transferable on third parties.
